Legal consulting · corporate insolvency

Strategic assistance from the first signs of difficulty. Legal clarity exactly when every choice matters.

Insolvency legal consulting covers the full spectrum of needs of a company facing financial difficulties: from the first signs (negative cash flow, pressing creditors, imminent enforcement) to the final decision on the procedure to follow.

We assist both debtors (the company in difficulty) and creditors (banks, suppliers, shareholders with claims) at every stage of insolvency proceedings: opening, claim verification, creditors’ committee, plan voting, challenges, distributions.

The consulting also covers adjacent matters: directors’ liability, recovery of fraudulently transferred assets, tax optimization in the insolvency context, dealings with the tax authority (ANAF) and other institutions. The goal: protecting your capital and your rights, whichever side of the procedure you are on.

Why this procedure
  • Assistance for both debtors and creditors
  • Complete coverage of all procedural stages
  • Preventive advice — before the situation becomes critical
  • Academic expertise applied in practice
Frequently asked questions
Who is insolvency consulting for?
Debtors who want to understand their options before filing, creditors who want to recover their claims from an open procedure, directors and shareholders who want to protect themselves from liability, and investors interested in assets sold in insolvency.
When should I consult an insolvency practitioner?
As early as possible — at the first signs of financial difficulty. Romanian Law 85/2014 requires the debtor to request the opening of proceedings within 30 days of the onset of insolvency; missing the deadline can trigger directors’ liability. The earlier the intervention, the more rescue options remain available.
What does the first consultation involve?
An analysis of the financial and legal situation, identification of the realistic options (preventive procedures, reorganization, liquidation) and a strategy recommendation with concrete steps. The discussion is covered by professional confidentiality.
